Dock Stay | Terms and Conditions
1. INTERPRETATIONS
(a) Words which are Capitalised have meanings as defined in this agreement and as set out in the schedule to this agreement.
2. CHARTER
(a) The Owner agrees to let the Yacht to the Charterer for the Charter Period on the terms and conditions set out in each individual company's agreement (including the schedule) ("charterer").
3. PAYMENT
3.(a) A deposit amount, set by the individual company's payment schedule - typically 20-50% of the Total Charter cost must be paid to secure the booking, with the balance to be paid in full as per the time-frame stipulated within the individual Terms and Conditions between Charterer and Charter Company prior to the commencement of the Charter.
3.(b) Payments may be made by way of Credit Card, or Electronic Funds Transfer.
3. (c) Extra charges incurred by the Charterer or any passenger during the Charter must be paid prior to departing the Vessel at the completion of the Charter.
4. CANCELLATION
4. (a) The booking and cancellation policy for your vessel charter holiday will depend on the Vessel that you have booked. Each vessel will harbour their own specific terms and conditions relevant to their company's product policies. Please refer to each yacht’s individual Terms and Conditions web page on our website to find the relevant details for your booking, or contact our Experienced Charter Advisors via bookings@whitsundaybluecharteradvisors.com or 1300 829 600.

(a) Any advertisement links available on this website may be affiliate links & we may earn a commission if you make a click through these links. 1. BOOKINGS & RESERVATIONS
1.1. All yacht charters are subject to availability and must be confirmed by Yacht Stay.
1.2. A reservation deposit is required to secure your booking, and the total charter fee must be paid before the charter begins.
1.3. Charter bookings are made for a specific yacht, and any changes to the yacht require approval from Yacht Stay.
2. CANCELLATION & REFUNDS
2.1. Cancellation policies vary depending on the specific yacht and will be communicated to you upon booking confirmation.
3. CHARTER ITINERARY
3.1. The charter itinerary will be provided to you in advance and is subject to change due to weather conditions or other unforeseen events. Note: dock-stays are limited to the Marina only. The Yacht will not depart their designated Harbour during your stay.
4. YACHT USE & RULES
4.1. The yacht shall only be used for recreational purposes and according to the rules and regulations set by Yacht Stay and the yacht owner.
4.2. The number of guests on board must not exceed the yacht's maximum capacity.
4.3. Smoking, illegal substances, and hazardous activities are strictly prohibited on board.
4.4. Pets may not be allowed on board; please check with Yacht Stay regarding the yacht's policy.
5. SECURITY DEPOSIT
5.1. A security deposit may be required to cover potential damages or additional charges during the charter.
5.2. The security deposit will be refunded after the charter, minus any applicable deductions.
6. RESPONSIBILITIES OF YOUR STAY
6.1. The Owner of your chosen Yacht will ensure the yacht is in seaworthy condition and that it complies with safety standards.
6.2. Your chosen Yacht will provide a qualified crew to ensure a safe and enjoyable charter experience.
7. RESPONSIBILITIES OF THE CHARTERER
7.1. The charterer and all guests must follow the instructions of the yacht's crew for safety and enjoyment.
7.2. Any damages caused by the charterer or guests will be the responsibility of the charterer.
7.3. The charterer shall provide accurate and truthful information to Yacht Stay.
8. INSURANCE
8.1. It is highly recommended for the charterer to obtain appropriate insurance for the charter period.
9. DISPUTES
9.1. Any disputes or claims arising from the charter shall be resolved in accordance with local laws and regulations.
10. PRIVACY & DATA HANDLING
10.1. Yacht Stay will handle your personal information in accordance with our privacy policy.
11. GOVERNING LAW
11.1. These Terms and Conditions are governed by the laws of Whitsunday Islands, Queensland, Australia and any disputes shall be subject to the exclusive jurisdiction of the local courts.
